Warum die Geringfügigkeitsschwellen der LAWA vorerst nicht verrechtlicht werden – oder: wie besetze ich Ermessensspielräume

Die Geringfügigkeitsschwellen (GFS) der LAWA und das zugrundeliegende Konzept sind löbliche Zieldefinitionen. Es besteht allerdings dem Vernehmen nach die Gefahr der unreflektierten Totalanwendung des GFS-Konzeptes. Der vorliegende Artikel bewertet diese Forderung und damit die Besetzung des Ermessensspielraums des WHG und befürwortet die von der Bundesregierung auf den Weg gebrachte Mantelverordnung als gesunden Kompromiss.

The Minimum thresholds set by LAWA and the basic concept are highly commended definitions of environmental targets. According to certain sources, the full and direct application to waste management issues of these thresholds has been requested. The present article evaluates the sustainability of this request together with occupying the margin of discretion provided by the German Water Act. At the end of the day, the author appreciates the present ordinance package by the German Federal Ministry of Environment as a sound compromise.
