Whistleblowing in Germany
Requirements under GDPR and Expected Amendments pursuant to the new EU Whistleblowing Directive

Following the effective date of the GDPR, the German Data Protection Authorities have updated their guidelines on the processing of personal data relating to whistleblowing systems end of 2018, and German-based companies have been forced to adjust any existing whistleblowing systems. At the end of 2019, the Directive (EU) 2019/1937 on the protection of persons who report breaches of Union law („Whistleblowing Directive“) entered into force requiring Member States to transpose the Whistleblowing Directive into national laws and to apply such national laws as of 17 December 2021. These developments give reasons to analyse the current legal requirements under GDPR for whistleblowing systems and to assess the impact of the Whistleblowing Directive more closely.
