Frankreich hat als größter Agrarproduzent der EU ein enormes Potential für die Energiegewinnung aus Biomasse. Im Vergleich zum deutschen Biogasmarkt ist der französische jedoch noch im Entstehen. Der französische Biogasmarkt bietet für deutsche Projektentwickler hervorragende Chancen der Wertschöpfung. Bislang konnte das Potential des französischen Marktes aufgrund administrativer und legislativer Hürden nicht ausgeschöpft werden. Die Nutzung von Biomasse steht nun aber seit dem französischen Umweltgipfel Grenelle II ganz oben auf der französischen Agenda. Gesetzliche Neuerungen vereinfachen das bislang komplexe Genehmigungsverfahren, mehr Transparenz bietet deutschen Projektentwicklern Rechtssicherheit. Auch die Einspeisung von Biogas ins Erdgasnetz wird künftig möglich sein.

Biogas production in France has continued to rise over the last few years. However, the French biogas market still remains seriously underdeveloped, partly because it has been overshadowed by other renewables such as wind energy. France has lagged behind other European countries, notably Germany, in developing the biogas market. Although France’s biogas potential as a market and investment opportunity continues to intrigue and attract many foreign companies, many are also aware of the legal challenges and the administrative hurdles. Nontechnical barriers are hampering the market’s take-off. This article deals with problems that German companies may encounter when entering the French biogas market. It thoroughly discusses the legal framework for the construction and the operation of biogas plants in France. The complex immission control licensing procedures (Facilities Classified for the Protection of the Environment – ICPE) is explained in detail. New legal tools will certainly give a strong impetus to the injection of biogas to the grid.
